Arizona Elk Society’s Polaris Ranger Raffle Official Rules & Regulations
By participating in this fundraising promotion, each ticket purchaser agrees that:
These Official Rules & Regulations govern the conduct of the Arizona Elk Society Polaris® Ranger Raffle Fundraiser and, together with the decisions of Arizona Elk Society are binding on everyone who purchases a ticket(s) and/or who is named on a ticket. Arizona Elk Society’s Polaris® Ranger Raffle Fundraiser is a fundraising activity in support of and conducted by Arizona Elk Society with proceeds benefiting the Arizona Elk Society, Wildlife for Tomorrow, and Special Olympics Arizona. These Official Rules and Regulations may not be waived, modified or supplemented unless such waiver, modification or supplementation is made in writing by Arizona Elk Society. Winners will be announced no later than December 20, 2021.
PRIZE DRAWING: The Prize drawings for Arizona Elk Society’s RideNow Fundraiser will be held no later than December 11, 2021 except this date and all other dates stated in these rules may be extended or curtailed at the absolute discretion of Arizona Elk Society. Winner do not need to be present to win.
TICKETS: Tickets may be purchased in the following ways:
1. Online via Arizona Elk Society until 11:59 PM AZMST November 28, 2021.
2. From an Arizona Elk Society representative by November 28, 2021.
Raffle Closes at 11:59 PM AZMST on November 28, 2021.
Drawing will be held on December 11, 2021 location to be announced.
Ticket prices are $20.00 each. There is no limit to the number of tickets to be sold. Any requests and payments received following the cut off time will be returned to the sender. Each ticket will have a separate and equal chance to win.
The Grand Prize Winner assumes and must pay all income taxes, local, state and federal taxes when the vehicle is transferred to the Grand Prize Winner. In addition, all costs of vehicle ownership, such as (without limitation) insurance, extended warranties and accessories, are the Winner’s sole responsibility. Arizona Elk Society assumes no responsibility for paying the Grand Prize Winner’s income tax obligations and suggests the Winner consult a tax advisor. Arizona Elk Society will collect the income tax from the Grand Prize Winner. A Form 1099 will be filed with the IRS to report the value of the prize won. The Grand Prize Winner will also receive a copy of these forms. This offer is void where prohibited by law and all federal, state and local laws and regulations apply.
SPECIAL NOTE: At the time of this printing, federal law requires that corresponding tax withholding on prize values in excess of $5,000.00 must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
THE PRIZES: There are a total of seven (7) prizes, one grand prize and six secondary prizes:
The Grand Prize a 2021 Polaris® Ranger Crew® XP 1000 EPS Premium. Color: Sunset Red Metallic. Added Accessories: Poly Crew Sport Roof in Black – Value $539.99; UTV Street Legal Kit – Value $199.99. Total Value$18,837.99 from RideNow Powersports, which includes Sales Tax, License, Registration and Doc Fees. RideNow Powersports will conduct the title and registration of the vehicle directly in the Prize winner’s name. Depictions of the vehicle shown in informational materials on Arizona Elk Society website and elsewhere can be found on Polaris.com. Polaris® is a registered trademark of Polaris. The 2021 Polaris® Ranger shown in photos is a mockup of the actual vehicle representative of the Prize. Not all features shown in the product photos are included. The Grand Prize will be drawn first and the secondary prizes will be drawn in the order listed above.
By participating in this fundraising promotion, all ticket purchasers and the person named on each customer receipt accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by Arizona Elk Society or the State Employee Charitable Campaign (SECC), for publicity purposes and naming of the prize winner to be published in any newspapers or other media including television, radio, web and print. The Winners’ names may be published in the SECC newsletter email blast and/or on SECC’s website. The name of the winners will be published on the www.aes-secc.org or found on SECC’s website. Arizona Elk Society’s interpretation and application of the rules and regulations shall be final.
By participating in this fundraising promotion, each participant releases Arizona Elk Society and each of its respective directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind, including, but not limited to, liability for injuries, losses, or damages arising from or caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold Arizona Elk Society and each of their respective directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize.
ELIGIBILITY: Ticket purchasers and the person named on the receipt must be at least 18 years of age at the time of purchase, a United States citizen, and a resident of Arizona or a state where 501(c)3 raffles are legal. Check your local state jurisdiction. Tickets may not be purchased in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Members of the Board of Directors, officers or employees, contractors, or subcontractors of Arizona Elk Society; or persons related by blood or marriage living in the same household are not eligible to win the Prize. Prize winner may be required to sign an affidavit of eligibility. Offer void where prohibited by law.
In order for the Grand Prize Winner to receive the vehicle (subject to the other provisions in these rules), the Grand Prize Winner must elect to receive the vehicle by delivering written notice of that election to Arizona Elk Society no later than 30 days after being notified in writing about winning the Prize. While it is not required that the Winners be present to win, if the Winner is not present at the drawing, Arizona Elk Society shall notify the Winner by certified mail within seven (7) days after the drawing takes place which will require the Winner to claim the Prize within thirty (30) days upon receipt of written notice.
If a Winner does not wish to claim the Prize but wishes to donate it back to Arizona Elk Society the Winner shall provide Arizona Elk Society a written statement within thirty (30) days after receiving written notice about winning the Prize stating that the winner wishes to donate the Prize to Arizona Elk Society.
If a Winner does not claim the Prize or donate it back to Arizona Elk Society within thirty (30) days after having been contacted, a representative from Arizona Elk Society shall draw another ticket.
All tickets shall remain under the control of Arizona Elk Society until a Winner is identified and accepts the Prize.
The vehicle will be transferred to the Grand Prize Winner in “AS IS, WHERE IS” condition by RideNow Powersports. Arizona Elk Society will not provide any guarantee or warranty, expressed or implied, in connection with the vehicle. Arizona Elk Society accepts no liability or responsibility regarding the manufacturing or condition of the vehicle. No warranties, express or implied, will be made or offered by Arizona Elk Society.
VEHICLE VALUE: The MSRP of the 2021 Polaris Ranger Crew XP 1000 EPS Premium with the added accessories, noted above, is $18,837.99. 2021 Sea Doo Fish Pro w/trailer est. value $16,199. The Internal Revenue Service or the Arizona Tax Commission will accept that value of the vehicle or any other value for the purpose of determining any income tax that may be payable by the Winner.
REFUNDS: All ticket sales are final. No refunds will be made except any ticket request with verified payment received after the deadlines set forth hereinabove will be returned. No other refunds are available. Arizona Elk Society assumes no responsibility for lost, late, misdirected or non-delivered orders, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A ticket purchaser’s sole and exclusive remedy for Arizona Elk Society breach shall be limited to the return of the purchase price paid for his or her ticket(s). In no event shall Arizona Elk Society or its respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
When a completed ticket order is placed directly from an Arizona Elk Society representative the purchaser will be given his/her portion of the ticket(s) or a receipt. Arizona Elk Society will enter ticket purchases into the ticket generating software.
TICKET AND PAYMENT VERIFICATION: Arizona Elk Society reserves the right to reject any ticket request form that is submitted with payment that does not constitute “good funds”. All defective or physically altered request forms are subject to disqualification at the discretion of Arizona Elk Society. Prior to the drawing, Arizona Elk Society will make a reasonable effort to notify any individual who submits such an entry form, or one which has been rejected because the credit card or check did not clear, that the entry has been rejected. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline.
WINNERS NOTIFICATION: Winners notification will be made by telephone, mail and posted on the State Employee Charitable Campaign’s and Arizona Elk Society websites. The Grand Prize winner will need to provide proper identification and complete an IRS Form W-9 and any other applicable documents to the satisfaction of Arizona Elk Society. A representative of Arizona Elk Society and RideNow Powersports will assist in coordinating all the details with the Grand Prize Winner regarding the delivery of the vehicle as well as license and registration of the 2021 Polaris® Ranger/Sea Doo Fish Pro. The Grand Prize Winner will be responsible for transporting the vehicle from the RideNow Powersports dealership in Phoenix, Arizona upon transfer of title to the Grand Prize Winner. Secondary Prize Winners will need to provide proper identification as noted above.
All Winners agree to the use of his/her name, photograph or videotape likeness and statements for publicity purposes by the Arizona Elk Society, State Employee Charitable Campaign (SECC) and RideNow and agrees to sign a publicity release without any further compensation as well as a release and waiver of liability, assumption of risk, and indemnity agreement.
ODDS OF WINNING: Odds of winning will be determined by the number of entries for applicable participants. Participants can only win one time.
